Penalties and criminal liability for tax evasion!

It’s tax season from March to July every year. Did you fill in your income truthfully when you filed your tax return? If your tax return is false, you can be fined up to RM20,000, imprisoned for up to 3 years, or both, and fined 300% of the amount of tax under-reported.

According to the Inland Revenue Department (LHDNM) website, those who fail to report their actual income can be fined between RM1,000 and RM10,000 or 200% of the amount of tax under-reported. A person who knowingly evades tax or helps another person to evade tax is liable to a fine of RM1,000 to RM20,000, imprisonment for a term not exceeding 3 years, or a concurrent fine of 300% of the amount of tax under-reported.

A person who interferes with or obstructs an officer of the Inland Revenue Department in the performance of his duties is liable to a fine of RM1,000 to RM10,000, imprisonment for a term not exceeding one year or both. Failure to provide information requested by the Inland Revenue Department is punishable by a fine of RM200 to RM20,000 and imprisonment for a term not exceeding 6 months, or both.

If you change your address and then fail to notify the Inland Revenue Department within 3 months, you may also be fined between RM200 and RM20,000, imprisoned for a period not exceeding 6 months, or both.

If you fail to pay the tax by the due date, you may be subject to a penalty of 10% of the tax due. If you fail to pay the tax within 60 days of the due date, the penalty will be increased by a further 5%.
