If you transfer money to someone else by mistake, you should first report it to the police. Then, with the report document in hand, go to your local bank branch and ask for assistance in tracking down the funds.
Since the funds have been moved to the other party’s bank account, the bank has no legal authority to return the funds to your account. A bank clerk will assist you in contacting the person and asking if they would like the money returned. If the other party agrees to return it, the other party must fill out the form at the bank branch.
If the other party refuses to return the money, you will have to go to court. You can file a claim in Small Claims Court if the sum is less than RM5,000. If the sum is greater than RM5,000, you must have a lawyer provide a lawyer’s letter.
