A senior citizen is requesting a trial for three counts of careless and dangerous driving.

In this Magistrate’s Court, a 76-year-old woman entered a not guilty plea to three counts of careless and dangerous driving.

Tan Leuk Ley requested a trial before Magistrate Siti Nurul Suhaila Baharin on all three of the charges read under Section 42(1) of the Road Transport Act 1987.

If found guilty, the charge carries a maximum five-year prison sentence as well as a fine of RM5,000 to RM15,000 in addition to other penalties.

Tan is accused of speeding dangerously and colliding with Muhammad Afiq Roszani, a 23-year-old motorcycle, on November 27, 2018, at approximately 2:15 p.m. on Jalan Bukit Gambir.

She is also charged with knocking into 40-year-old motorcyclist and his 15-year-old pillion rider Nur Irfan Hakim Mohd Nor Ezrie at the same location, time and date.

For the third charge, Tan allegedly drove recklessly and knocked into the motorcycle of 22-year-old Muhammad Syamil Zulkarnian and Kristina Abdullah, 22, at the same location, time and date.

In submissions for bail, Deputy Public Prosecutor Nurul Atikah Asharaf Ali urged the court to set RM10,000 for each charge.

Tan’s attorney, Dev Kumaraendran, responded in mitigation, stating that his client is a retired police clerk who worked for thirty years before to retirement due to a cholesteatoma that required three surgeries.

She is hard of hearing and is still receiving treatment for it. She poses no flight risk and has never attempted to evade the investigation. In order to ensure that she appears in court and that the bond amount is not a punishment, I implore the judge to lower it,” he stated.

Siti Nurul Suhaila set a single surety’s bail of RM15,000 for each of the three accusations.

“I add on a condition that the accused and her family must not disturb the victims,” she stated.

She then scheduled the paperwork and medical report submission for March 8.
