Thailand was the first Asian country to legalize marijuana, yet many people are concerned about being jailed if they return to Malaysia after ingesting marijuana in Thailand.
According to practicing lawyer Tan Zu bīn, who has three years of experience in this matter, the outcome depends on the urine test results. However, if you ingest or smoke marijuana in Thailand and test positive on urine testing upon arrival in Malaysia, you will be arrested.
Tan Zu bīn posted on his Instagram legal consultation page, “lawyerboy22,” stating that under the Dangerous Drugs Act 1952, marijuana in any form, whether in plant or extracted form, is considered a dangerous drug in Malaysia.
According to Tan Zu bīn, under the Dangerous Drugs Act 1952, consuming or injecting drugs in Malaysia is a criminal offense. If convicted, the maximum penalty is up to two years in prison or a fine of RM 2,000.
He stated that urine tests are widely used by police and customs authorities to detect whether or not someone has ingested or smoked marijuana.
The urine test is declared positive if it detects more than 50 nanograms (ng) of tetrahydrocannabinol (THC), a chemical component produced by the breakdown of marijuana.
“According to Section 37(k) of the Dangerous Drugs Act 1952, if the urine test results are positive, the law will assume that you have consumed or injected drugs unless you have evidence to prove otherwise.”
Tan Zu Bin stated that according to the research of Professor Dr. Mohammad Aris Mohd Moklas if the marijuana consumed or smoked by tourists adheres to the legal dosage set by the Thai government, the urine test will show positive results for up to 3 days after consumption or smoking marijuana in Thailand before it is considered “safe” to return to Malaysia without being arrested for drug use.
According to one study, the longer and more regular marijuana usage, the longer the detection period in urine, which can be up to 30 days.
As a result, Tan Zu Bin warns the public that Malaysia has harsh drug-related legislation.
“As a result, if you consume or smoke marijuana in Thailand, you may be arrested upon entry into Malaysia.”
Police and customs officials are said to perform random testing on passengers entering Malaysia from Thailand.
Tan Zu Bin recommends that if you want to use or smoke marijuana, you should be prepared to be jailed upon your return to Malaysia. The most secure way is to avoid all interactions with marijuana.
“However, if you insist on trying, you must manage the timing and ensure that the tetrahydrocannabinol (THC) in your body has been eliminated before entering Malaysia.”
