Many people are concerned whether they can enjoy the compensatory holiday on February 3.

Every year, February 1 is Federal Territory Day and Kuala Lumpur, Putrajaya and Labuan will enjoy the holiday on February 1. This year, February 1 coincides with the first day of the Lunar New Year, which means that the first day of the Lunar New Year holiday clashes with Federal Territory Day.

According to the Malaysian Cabinet, under the Public Holidays Act 1951 (Act 369), public holidays can only be substituted with holidays on Fridays or Sundays. The first day of Lunar New Year and Federal Territory Day falls on a Tuesday and working persons protected by the Public Holidays Act 1951 are not automatically entitled to compensatory leave.

Workers covered by the Labor Act of 1955 (Act 265) are entitled to compensatory time off. If your cover letter is under the Labour Act 1955, workers in Kuala Lumpur, Putrajaya and Labuan are entitled to paid leave on February 3.
