Employees can enjoy 11 days of paid leave in 2022, where 5 days are statutory public holidays, and the remaining 6 days are determined by the employer.
According to Article 60D of the Labor Act of 1955, all employees must enjoy 11 days of paid public leave each year, of which 5 days are statutory public holidays, namely National Day, the Agong’s birthday, the Sultan’s birthday or Yang di-Pertua Negeri’s birthday, or the Federal Territory Day, Labor Day And Malaysia Day.
In addition to the statutory 5 days of public holidays, the remaining 6 days of alternative public leave are determined by the employer. The decree also clearly states that if an employer requires an employee to work on 11 days of paid public holidays, the employee can be entitled to double pay or one-day holiday benefits.
In addition, the Malaysian Labor Law also stipulates that the normal working hours are 8 hours a day or 48 hours a week. If employees are required to work overtime (OT), they will not exceed 12 hours, and the remuneration must be 1.5 times the usual salary, 2 times the vacation days, and 3 times the national holiday.
In addition, migrant workers who have served for 2 years or less are required to enjoy 8 days of annual leave (Annual Leave) each year, and 12 days of annual leave are required for 2 to 5 years of service. Workers who have served for 5 years or more must enjoy 16 days of paid annual leave each year.
