#1 Make sure you and the people around you are safe
In the event of a car accident, drivers should first check if they are injured and then ensure that their surroundings are safe and that the other party is not in possession of an offensive weapon before getting out of the car.
#2 Take pictures/record information about the other party
Take pictures of the other party’s license plate number, the other party’s and your own car after being hit for the police’s reference, and if both parties agree, take pictures of the other party’s ID and driver’s license.
#3 Call the police and seek help from your insurance company
According to Malaysian law, the Road Traffic Act 1987, all car owners involved in a car accident must report the accident to the police within 24 hours of the accident and may be fined for late reporting without reasonable cause. Therefore, it is advisable to contact your insurance company for assistance in the event of a car accident!
#4 Report to the police and complete a series of procedures
Upon arrival at the police station, give all relevant information, photos or videos to the police, make a statement and get a Police Report. After the questioning, go to the counter and pay for the Investigation Report in order to apply for insurance compensation. You can collect the report with the receipt two weeks after!
#5 Understanding Auto Insurance
Regardless of the size of the accident, when the other party wants to settle the case privately, you should notify your insurance company according to the terms of your auto insurance, as this will protect your rights. Even if the other party later reneges on their promise and files a third party personal injury (TPBI) or third party property damage (TPPD) claim against you, at least the insurance company will be aware of the situation.
