Employees will have 11 paid leaves in 2023.

Malaysia’s employees can expect 11 days of paid holidays in 2023, with 5 days designated as statutory public holidays and the remaining 6 days determined by employers.

According to Article 60D of the Employment Act of 1955, all working people are entitled to 11 paid public holidays per year, five of which are statutory, namely National Day, the birthday of the head of state, the birthday of the Sultan or the head of state or the day of the Federal Territory, Labor Day, and Malaysia Day.

In addition to the statutory 5 days of public holidays, the employer determines the remaining 6 days of alternative public holidays. The decree also states unequivocally that if an employer requires an employee to work on 11 paid public holidays, the employee is entitled to double pay or the benefits of making up one day of holiday.

Furthermore, the Employment (Amendment) Act, which goes into effect on January 1, 2023, states that normal working hours are limited to 45 hours per week. If the employee is required to work overtime (OT), the time limit is 12 hours, and the pay must be 1.5 times the regular salary, 2 times the holiday, and 3 times the statutory holiday.

Furthermore, workers who have served for two years or less must take eight days of annual leave, while those who have served for two to five years must take twelve days of annual leave per year. Migrant workers who have been with the company for five years or more are entitled to 16 days of paid annual leave per year.
