If you use your phone while driving, you must go to court

Notice! You must appear in court if you get a summons with the reasons for using a phone while driving.

Police will strictly enforce the law on those who use their phones while driving beginning July 10, 2020. Violators cannot pay their fines at the traffic police station; instead, they must go to the court and hand it over for adjudication. Violators will be fined by the court. If you unable to pay the fine, you will be sentenced to prison.

Using phone while driving is a leading cause of traffic accidents. Section 17A of the Road Transport Act 1959, taken along with Section 128(1) of the Road Transport Act 1987, makes it illegal.

A Non-Compound summons, or NC for short, will be issued to drivers who use their phones while driving. Those who are issued a NC summon must appear in court to accept the verdict of the court.

First-time offenders will face a fine fine of up to RM1,000 or a three-month jail sentence, while repeat offenders will face a fine of up to RM2,000 or a six-month jail sentence, or both.

The public is reminded not to use their phones while driving, including voice calls, text messaging, navigation, and so on, as this puts other road users’ safety at risk.
